Injured Rescuer Sues Hiker he was Sent to Rescue

When you are young, making mistakes is a fact of life. Young adults often engage in risky behavior that not only places themselves in danger, but have the potential of placing others in harm’s way. Sometimes, things can happen unexpectedly and the course of events is no one’s fault at all. A situation such as this happened when a volunteer rescuer broke his back while searching for two missing hikers in Orange County California in April 2013.

Nick Papageorge has filed a lawsuit in Orange County court against one of the missing hikers alleging that he fell off a cliff while looking for Kyndall Jack, 19, and Nic Cendoya 20, which resulted in a fall that left him seriously injured.

The lawsuit alleges that one of the hikers, Jack, was unprepared for his hike and the excursion was taken with the intention of taking hallucinogens. Cendoya had entered a plea of guilty to drug possession when methamphetamine was found in his car, but the lawsuit names only Jack. Papageorge’s counsel would not elaborate as to why the other hiker was left out of the lawsuit.
